The German "Sorgfaltskorridor" (circumspection corridor) of § 276 Abs. 2 BGB includes partial aspects of diagnostics (clinical findings and securing a diagnosis, therapy -including choice of therapy, fault of a referral as well as clarification of a process and documentation. With regard to juridical aspects, guidelines and evidence base are incapable of subsumption, so they cannot account for a typical professional standard in the sense of an objective criterion. Only deviations from a case-individual circumspection standard are relevant to liability. However, due to the complexity of the equine disease "colic" a reversal of the burden of proof is only rarely taken into account in exceptional cases.
