The relevance of the topic is due to current trends in building digital states in the world, which in turn requires the creation of a special legal regulation. The article analyzes the experience of the Federal Penitentiary Service of Russia in implementing the tasks of the penitentiary system using digital technologies, and highlights the reasons that hinder this process. The methodological basis of the research is the method of scientific knowledgea comparative legal method. The efficiency of digital transformation of the powers of the Federal penitentiary service as part of the digital state is determined. The author came to the conclusion that in order to implement the basic principles of the constitutional system of the digital state within the powers of the Federal Penitentiary Service of Russia, it is necessary to create a special digital platform, provide technical capabilities, and make changes to the Criminal Executive Code of the Russian Federation.
