Todas estas doutrinas são caracterizadas pela busca de um fundamento do direito na comunidade política, em uma dimensão mais profunda do que a ligada à simples vigência formal da lei do Estado. Tal coerência entra em crise no século XX, quando se assiste a um uso polêmico da constituição em sentido material, contra a lei do Parlamento, entendida como mera legalidade formal. Somente com as Constituições da segunda metade do século são criadas as condições para a formação de uma doutrina que tenta vincular a origem da Constituição vigente à dimensão profunda da comunidade política. Abstract The essay analyzes the main theories of the concept of constitution in a material sense. These theories are characterized for looking for the foundations of law in the political community, without reducing it to the formal dimension of the law. It has been in this way since the rule of law principle of the 19 th century, based on historic grounds linked to Savigny. This theory is indeed based upon the idea of the legal order of the Nation, which logical expression is the law of the State. This coherence would disappear at the 20 th century, due to the controversial use of the notion of material constitution as opposed to the law of the Parliament, understood as mere formal legislation.
