Resumo: O presente texto tem como objetivo discutir o acesso à jutiça como o mais "básico dos direitos humanos" e o modo como ele vem se concretizando no Brasil pós Constituição de 1988. Nessa mesma linha de raciocínio o texto aborda o Estado como detentor do monopólio da força enquanto instituição legitimada a "dizer o direito" determinando quem ganha e quem perde a demanda. Abstract: The present text inquiry the access to Justice as the "basic human right" and the way they are enforced in Brazil, after the adoption of the Constitution of 1988. Trough this reason the text focuses the State as the possessor of the monopoly of the use of force, while a lawful institution to "decide the rights", determining who succeed and who loses the litigation. Though, the crisis through which the actual jurisdiction faces are going to be exposed, as well as, inquiring the possible alternatives to this crisis.
