RESUMO: Não é difícil percebermos que há algo de errado com o Brasil, basta um breve olhar ao redor para percebermos que estamos enfrentando desordens nítidas. Pessoas passando fome falta de vagas em hospitais, tetos de escolas caindo sobre os alunos, falta de postos de trabalho, poderíamos escrever inúmeros casos, mas em resumo nosso país enfrente uma crise social profunda e complexa. ... é esse" 1 , a qual trazendo de forma poética e musical nos aponta uma das características do problema: "ninguém respeita a constituição, mas todos acreditam no futuro da nação". Aqui nós temos um dos pontos importantes a serem refletidos e tratados, o respeito à Constituição Federal do Brasil, não sendo difícil de se perceber que esse desrespeito, ou seja, esse o descumprimento é latente. Como proposta de estudo, buscaremos refletir se há ou não uma importância do Poder judiciário para solucionarmos essa questão, ele deve atuar ou não? Isso deflagraria um desrespeito ao Estado Democrático de Direito? Entre outras indagações sérias e de suma importância, buscaremos tratar e achar uma luz em meio à escuridão da degradação social. ABSTRACT: It is not difficult to realize that there is something wrong with Brazil, just a brief look around to realize that we are facing sharp disorders.
