ABSTRACT The present investigation aims to determinate the factors of the inefficiency on the application of the administrative and criminal legal framework, for the protection of the national sanctuary "Los Manglares de Tumbes" and elaborate a sustainable protection proposal of the sanctuary. The sample was made up of 366 of the suburbs habitants of the buffer zone, the police reports, attestations and judicial processes which were processed in the Tumbes and Zarumilla area. It is concluded that the factors that prevent the application of the administrative and criminal legal framework to be effective on the sustainable protection of the Sanctuary are: the existent discordance between the administrative and criminal current norms, which make it difficult to apply, in addition, such rules are benign, which means that their application is not justified, on the other side, despite that there are judicial and administrative investigations already tramited, very few people were penalized or convicted. Therefore, the deficient application of the legal framework does not guarantee the sustainable protection of the Sanctuary.
