RESUMO O artigo examina a justificação kantiana para a universalidade da lei moral, justificação esta fundada na subjetividade, isto é, num sujeito tomado como universal, bem como a crítica habermasiana a forma de legitimar essa universalidade, uma vez que ele propõe, em contrapartida, uma ética do discurso, cuja validez universal da norma é buscada não na consciência individual, mas no reconhecimento desta por todos os concernidos, portanto, através de um entendimento intersubjetivo.

ABSTRACT The article examines the Kantian justification for the universality of the moral law, this justification based on subjectivity, that is, a subject taken as universal as well as the critical Habermas the way of legitimizing this universality, as he proposes, in contrast, a ethical speech, which is the standard universally valid fetched than individual consciousness, but this recognition by all concerned, therefore, through an inter-subjective understanding. It also aims to point out some weaknesses present in both conceptions.
