THE LIMITATION OF THE EQUITY LIABILITY OF PARTNERS IN THE FRAMEWORK OF MEDIEVAL CORPORATE STRUCTURES

The present article investigates how the custom of limiting the responsibility of the partners arose and developed in the structure of the medieval commercial societies and in what form was later outlined in the framework of the first joint stock companies. Through a bibliographical research, it was found that it is not possible to say with certainty which of the medieval societal species was the first to agree to the practice of limiting the patrimonial responsibility of the partner in the
more » ... le Ages. On the other hand, individual examination of medieval structures served to reveal how this technique evolved differently in each societal species. It was also observed that economic and political factors were decisive for the improvement / development of this method of risk mitigation to encourage capitalists to invest in the first joint stock companies. In the same sense, through the examination of the first colonial companies it was possible to identify how the principle that limited the liability of members varied until reaching all the categories of members in the modern societies by actions.
