Before new herbage cultivars can be sold in any EU member state (MS) and gain EU-wide marketing, they must pass official tests to prove they are both novel and improved. Two independent regulatory systems are employed. Plant breeders' rights (PBR) protects existing registered cultivars from plagiaristic exploitation.
