more » ... ecisions of the Constitutional Court delivered within proceedings dealing with the compatibility of legislation. The Constitutional Court initially took a self-limiting approach which was, without explanation, not followed in subsequent decision-making. The only solid foundation for the forming doctrine in relation to the Charter is stating that the Charter must be considered as a treaty under article 7 section 5 of the Constitution.
