Resumo O artigo versa sobre a formação da nova classe trabalhadora denominada de batalhadores brasileiros, emergente de uma camada excluída e muitas vezes invisível da sociedade que Jessé Souza denomina como ralé estrutural. A partir da emergência dos batalhadores e do acelerado processo de consumo que vem realizando, procura-se abordar aspectos relacionados ao superendividamento, os limites na materialização de direitos fundamentais e a necessidade da proteção jurídica dos consumidores.
