RESUMO: Pretende-se analisar neste artigo a distinção, feita por Hume, entre convenção e contrato, bem como suas consequências para sua teoria da justiça. Abstract: This paper aims at analysing the distinction made by Hume between convention and contract, as well as its consequences to his theory of justice. In addition, starting from the discussion on the historic and artificial character of justice in Hume's philosophy, we intend to investigate which type of rationality is refused as fundament to the moral distinctions and to what extend this fact challenges the contractarianism theories. In this sense, the text attempts to point out how Hume grounds the 'pacta sunt servanda' principle in the constitution of a general reference system; that is, an implicit assumption of mutual fulfilment of agreements. Therefore, it questions the distinction between the interest involved in the origin of justice and the natural passions of benevolence and self-love; that is, it is dedicated to understanding the specific meaning of justice's artificiality in a connection to the composition of judgement and approval of fair acts.
