The right of self-determination has had an enormous upswing in the post-modern age. This basic right, however, still is not undisputed. Especially in care, nursing and treatment of persons with psychological disorders, a dilemma between the principle of autonomy and the principle of care cannot always be avoided. The law provides the institution of a custodian as a chance to support persons with serious mental illnesses in increasing their autonomy.
