У статті розглянуто основні проблеми механізму реалізації та захисту прав і свобод людини й громадянина в Україні. З'ясовано проблеми функціонування механізму безпосередньої реалізації прав і свобод громадян, їх причини та шляхи усунення. Автор на конкретних прикладах показує, що людина, її права, свободи й інтереси є першорядною цінністю суспільства. Розглянуто систему політичних прав і свобод в Україні як основу демократії та засіб громадського контролю. Зазначається, що ефективність реалізації вказаних прав і свобод залежить від досконалості правової сфери і впливає на розвиток демократизму. Автор наголошує на необхідності здійснити комплексний перегляд законодавства, зміцнити авторитет держави у суспільстві та удосконалити механізм захисту і забезпечення прав і свобод людини. This article is devoted to the global problem of the present, namely, the realization and protection of the rights and freedoms of a citizen in Ukraine. The article presents a comprehensive analysis of the factors influencing the process of realization of human rights in Ukraine. It is stated that Ukraine's path of integration into the European economic space requires harmonization of Ukrainian legislation with international legal requirements. The article states that at this stage of development of the Ukrainian state and society, the problem of ensuring the rights and freedoms of the individual becomes of particular importance, because in the modern world the degree of human rights and freedoms is a valuable benchmark, which testifies to the level of democracy achieved by the state, the degree of development of society. The author shows by concrete examples that a person, his rights, freedoms and interests are the main value of society. A conclusion is done, about a necessity to carry out the complex revision of legislation and perfect it. We consider a system of political rights and freedoms in Ukraine, as the foundation of democracy and a means of social control. It is noted that the effectiveness of the implementation of these rights and freedoms depends on the perfection of the legal sphere and influences the development of democracy. The author emphasizes the need for a comprehensive review of the legislation, to strengthen the authority of the state in society and to improve the mechanism of protection and guarantee of human rights and freedoms. Human rights are a particular global problem, the solution of which depends on each state, the quality of constitutional regulation and the constitutional regulation of social relations.
