O objetivo deste artigo é identificar os principais elementos que permitem reconhecer o direito ao desenvolvimento como um direito humano à luz da interpretação sistêmica pro homine que fundamenta a hermenêutica emancipatória dos direitos humanos no âmbito internacional, como também reafirmar o direito fundamental ao desenvolvimento à luz da cláusula de abertura material no âmbito interno constitucional, prevista no art.5º, §2º da Constituição de 1988.
