Abstract
The article examines the legality and validity of the sentence. The author believes that the requirements of legality and validity are interrelated. An unsubstantiated sentence is also illegal, since the law requires it to be justified. Observance of due process of legal proceedings, correct application of the criminal law are the criteria not only of legality, but also of validity and fairness of the sentence. The article also makes a conclusion about the special place of validity and objectivity of the court's verdict among its properties in view of the presumption of truth, the sentence that entered into legal force and its pre-judicial value.
