Abstract

Busca-se com o presente estudo analisar a possibilidade de o judiciário realizar controle de constitucionalidade em medidas provisórias. O controle de constitucionalidade é um instrumento para garantir a soberania de uma constituição, podendo ser exercido em diferentes momentos pelos três poderes. Por sua vez, a medida provisória é uma norma anômala, pois possui um processo legislativo diferenciado e decorre da função atípica do Poder Executivo, possuindo requisitos específicos previstos pela própria Constituição. Por essa razão, considerando que a MP é uma legislação pós-constitucional, é possível o exercício do controle de constitucionalidade judicial quando houver suspeita de vícios formais ou materiais na referida norma. ABSTRACT The aim of this study is to analyze the possibility for the judiciary to carry out constitutionality control in provisional measures. Judicial review is an instrument to guarantee the sovereignty of a constitution, which can be exercised at different times by the three powers. In turn, the provisional measure is an anomalous rule, as it has a differentiated legislative process and stems from the atypical function of the Executive Branch, having specific requirements provided for by the Constitution itself. For this reason, considering that the MP is a post-constitutional legislation, it is possible to exercise judicial control of constitutionality when there is suspicion of formal or material defects in the said norm.
