Abstract

Commodity trade agreements are one of the basic instruments of economic transactions and functioning of the economy in general. Their importance is immeasurable in any society. The economy is the fondation of each society, the basic factor of progress and development, its basic value, and there for its normal functioning and improvement is set as an imperative. In different socio-economic systems, the economy had different characteristics, but it also had different instruments and results. Comparatively speaking, we can be able to draw certain conclusions about what can be characterized independently of the constellation of socio-economic relations in one country, and draw parallels in which environment this have the best prospects for development. In general, the state of law, private property and freedom of contract, with minimal legal restrictions, are the most optimal environment for normal economic grout and quality of life, and for the overall development. The instruments that are in the role for functional economy, that is connecting people, that is satisfying their needs, that is allocating and rearranging the assets, creating new value, holding the community between people, and there for allowing the flow of commodity and ideas, and availability of products and services, is in one word the contracts. The contracts or trade agreements, are following the direction of the economy, but also they can have feedback effect on the economy. The autonomy of the will for party in contracts, is an fundamental value for this contracts. Science is the factor, that in the study of economic relations finds a solution, and then she theoreticly shape them and makes them practical for application. Economic and legal contracts have several characteristics that make them somewhat different from obligatory contracts, but they also have more than one of basic and systematic common features.
